PRIVACY POLICY
Travel Like Wind is committed to protecting your privacy when you visit Travel Like Wind or use its services (“Services”) as further outlined in this policy. As a condition of using the Services of Travel Like Wind, you agree to provide Travel Like Wind with certain personal information. This information includes, but is not limited to: email address and your computer’s unique IP address (if any), financial information (email address used by your Stripe account) and demographic information (e.g., zip code, purchase history information and age as well as IP addresses that are not unique to your computer). Please note that nowhere on the Site do we knowingly collect contact information or financial information from children under the age of 13. Please review this privacy policy periodically as we may update it from time to time. This privacy policy was last revised on Oct 9, 2017. Each time you visit Travel Like Wind, use the Services, or provide us with information, you are accepting the practices described in this privacy policy at that time. You agree that by using the Site you are expressly and affirmatively consenting to our use and disclosure of the information that you provide, and consenting to receive emails, as described below in this privacy policy.
This policy may be revised over time as new features are added to the Site or as we incorporate suggestions from our users. If we are going to use or disclose your personally identifiable information in a manner materially different from that stated at the time we collected the information, you will have a choice as to whether or not we use or disclose your information in this new manner. We will also post a notification that the Privacy Policy has been amended prominently on our Web site so that you can always review what information we gather, how we might use that information, and under which conditions we will disclose it to anyone.
We use contact information i.e. your email address to help us efficiently perform account tasks (changing passwords, retrieving lost passwords), to deliver the services you have requested, to perform quality assurance, sales analyses and other business analyses, and to contact you in connection with any orders that you have placed with us. No other use of your financial information will be made except to satisfy any law, regulation, governmental request, or judicial order. When you make a purchase through the Site, or register with the Site, you will provide us with an email address where we, or these service providers, may contact you for the purposes described in this paragraph.
You agree, in consideration for the use of the Services provided by Travel Like Wind, to allow Travel Like Wind to use your personal information to send you marketing and promotional materials. Travel Like Wind may also send you marketing and promotional materials that promote third party products. Travel Like Wind will not rent or sell your personal information for use by third parties. These materials may include, but are not limited to: newsletters providing you with additional information on how to use the Services, and promotional offers for goods and services from Travel Like Wind or third parties.
Travel Like Wind may use your demographic information to perform business analyses or to tailor the Site and communications to your interests. We may share anonymous, aggregated demographic information with advertisers and other third parties so that they can tailor their advertisements and communications to the appropriate audience. Any time that we are allowed under this privacy policy to share your contact information or financial information, we may also share your demographic information along with it.
Travel Like Wind may disclose specific contact information when we determine that such disclosure is necessary to comply with law, to cooperate with or seek assistance from law enforcement or to protect the interests or safety of Travel Like Wind or other visitors to the site or users of the Services. Also, your contact information may be passed on to a third party in the event of a merger, acquisition, consolidation, divestiture, or a bankruptcy of Travel Like Wind.
Cookies : A “cookie” is a small file that we save on your computer’s hard drive that contains non-personal information. These cookies help to give you faster access to pages you have already visited. They also allow you to personalize your pages, and optimize your experience at our sites. We also use cookies to help us figure out how many people visit our sites, which of our web pages they visit, and how long they stay there. This information helps us figure out which of our web features are highly successful and which sites might need improvement. You can disable cookies on your computer by indicating this in the preferences or options menus in your browser. Most browsers accept cookies automatically, but allow you to disable them. Disabling cookies may prevent you from properly using the Services or accessing the site.
Sessions : “Session IDs” allow us to identify a particular user across multiple web page requests. This Session ID is maintained within your cookie file, where possible. If cookies are not enabled, or if the user’s internet browser program does not support cookies then Travel Like Wind will place the Session ID in the requested web page. This allows the end user to avoid having to continually re-enter certain information such as account name and password for every web page request. This Session ID expires whenever the user closes their internet browser.
Tracking : Many of our web pages also contain special electronic images (called a “single-pixel gif” or “gifs”) that allow us to gather only non-personally identifiable traffic statistics and other aggregate information about visitors to our sites. Travel Like Wind (through itself or third parties) uses this technology to collect and accumulate anonymous data that helps us understand and analyze the experience of people visiting our web sites and, along with other information you provide, customize your future visits and improve our web sites. For example, we capture data on the type of browser used, operating system software (e.g. Windows 95 vs. 98 or Macintosh), cookie preferences (whether the user has them turned on or off), and search engine keywords (what key words did a visitor use to get to our site). We also record number of visits, paths taken, and time spent on sites and pages within Travel Like Wind’s web sites. Please keep in mind that none of this information is personally identifiable and that we only distribute this information to internal staff at Travel Like Wind and to partners that have signed confidentiality agreements with us. Any information that we do share with partners reflects overall web site or Internet usage trends, not individual.
IP Address : Each time you visit the Site, we automatically collect your IP address and the web page from which you came. In order to administer and optimize the Site for you and to diagnose problems with our Site, we use your IP address to help identify you and to gather broad demographic information about you. We also use your IP address to restrict the access of your account to broader users.
Storage : You understand and agree that Travel Like Wind stores and processes your information on computers located in Germany, and by providing any data to Travel Like Wind, you consent to the transfer of such information to Germany. When you a delete a file from your Travel Like Wind account, no link will remain between you and that file. Deleted files may stay cached in Travel Like Wind servers to save bandwidth in case other people request them.
- CONTRIBUTIONS TO Travel Like Wind
By submitting ideas, suggestions, documents, and/or proposals (“Contributions”) to Travel Like Wind through its suggestion or feedback webpages or email addresses, you acknowledge and agree that: (a) your Contributions do not contain confidential or proprietary information; (b) Travel Like Wind is not under any obligation of confidentiality, express or implied, with respect to the Contributions; (c) Travel Like Wind shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media worldwide; (d) Travel Like Wind may have something similar to the Contributions already under consideration or in development; (e) your Contributions automatically become the property of Travel Like Wind without any obligation of Travel Like Wind to you; and (f) you are not entitled to any compensation or reimbursement of any kind from Travel Like Wind under any circumstances.
XII. TERMINATION
You may terminate your Travel Like Wind account and access to the Travel Like Wind Services by submitting termination request to Travel Like Wind support. Account termination will be completed after you will get notice about successful termination from Travel Like Wind.
You agree that Travel Like Wind may, without prior notice, immediately terminate, limit your access to or suspend your Travel Like Wind account and access to the Travel Like Wind Services. Cause for such termination, limitation of access or suspension shall include, but not be limited to, (a) a breach or a violation of the TOS or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) discontinuance or material modification to the Travel Like Wind Services (or any part thereof), (d) unexpected technical or security issues or problems, (e) extended periods of inactivity, (f) engagement by you in fraudulent or illegal activities, and/or (g) nonpayment of any fees owed by you in connection with the Travel Like Wind Services. Travel Like Wind’s payment policies and subscription information is located at http://Travel Like Wind. Further, you agree that all terminations, limitations of access and suspensions for cause shall be made in Travel Like Wind’s sole discretion and that Travel Like Wind shall not be liable to you or any third party for any termination of your account, any associated email address, or access to the Travel Like Wind Services.
Termination of your Travel Like Wind account includes any or all of the following: (a) removal of access to all or part of the offerings within the Travel Like Wind Services, (b) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), (c) deletion of any Content or any part thereof posted by you, and (d) barring of further use of all or part of the Travel Like Wind Services.
XIII. INDEMNITY
You agree to indemnify and hold Travel Like Wind and its subsidiaries, affiliates, officers, agents, employees, partners, licensors and licensees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of Content you submit, post, transmit, modify or otherwise make available through the Travel Like Wind Services, your use of the Travel Like Wind Services, your connection to the Travel Like Wind Services, your connection to the global network, your violation of the TOS, or your violation of any rights of another.
XIV. DISCLAIMER OF WARRANTIES and LIMITATION OF LIABILITY
By submitting ideas, suggestions, documents, and/or proposals (“Contributions”) to Travel Like Wind through its suggestion or feedback webpages or email addresses, you acknowledge and agree that: (a) your Contributions do not contain confidential or proprietary information; (b) Travel Like Wind is not under any obligation of confidentiality, express or implied, with respect to the Contributions; (c) Travel Like Wind shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media worldwide; (d) Travel Like Wind may have something similar to the Contributions already under consideration or in development; (e) your Contributions automatically become the property of Travel Like Wind without any obligation of Travel Like Wind to you; and (f) you are not entitled to any compensation or reimbursement of any kind from Travel Like Wind under any circumstances.
You expressly understand and agree that:
(a) your use of the Travel Like Wind services and software are at your sole risk. the Travel Like Wind services and software are provided on an “as is” and “as available” basis. Travel Like Wind and its subsidiaries, affiliates, officers, employees, agents, partners, licensors and licensees expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of title, merchantability, fitness for a particular purpose and non-infringement.
(b) Travel Like Wind and its subsidiaries, affiliates, officers, employees, agents, partners, licensors and licensees make no warranty that (i) the Travel Like Wind services or software will meet your requirements; (ii) the Travel Like Wind services or software will be uninterrupted, timely, secure or error-free; (iii) the results that may be obtained from the use of the Travel Like Wind services or software will be accurate or reliable; (iv) the quality of any products, services, information or other material purchased or obtained by you through the Travel Like Wind services or software will meet your expectations; (v) that you find the interface developed by the software to be user friendly and (v) any errors in the software will be corrected.
(c) any material ed or otherwise obtained through the use of the Travel Like Wind services or software is accessed at your own discretion and risk, and you will be solely responsible for and hereby waive any and all claims and causes of action with respect to any damage to your computer system, internet access, or display device, or loss of data that results from the of any such material.
(d) no advice or information, whether oral or written, obtained by you from Travel Like Wind or through or from the Travel Like Wind services or software shall create any warranty not expressly stated in the tos.
You expressly understand and agree that Travel Like Wind and its subsidiaries, affiliates, officers, employees, agents, partners, licensors and licensees shall not be liable to you for any punitive, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Travel Like Wind has been advised of the possibility of such damages), resulting from: (a) the use or the inability to use the Travel Like Wind services; (b) the cost of procurement of substitute goods and services; (c) unauthorized access to or alteration of your transmissions or data; (d) statements or conduct of any third party on the Travel Like Wind services; or (e) any other matter relating to the Travel Like Wind services.
Unless explicitly stated otherwise, any new features augmenting or enhancing the current Travel Like Wind Services, including the release of new Travel Like Wind properties, shall be subject to these TOS. You understand and agree that the Travel Like Wind Services are provided “AS-IS” and that Travel Like Wind assumes no responsibility for the timeliness, deletion, mis-delivery or failure to post or store any user communications or personalization settings. You further understand that Travel Like Wind Services may be interrupted and Travel Like Wind and the entities providing hosted servers shall not be liable for interruptions. You are responsible for obtaining access to the Travel Like Wind website and the Travel Like Wind Services, and that access may involve third-party fees (such as Internet service provider or airtime charges). You are responsible for those fees, including those fees associated with your subscription to the Travel Like Wind Services as hereinafter described. In addition, you must provide and are responsible for all equipment necessary to access the Travel Like Wind Services. You understand that the technical processing and transmission of the Travel Like Wind Services, including your postings or content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations of sections 19 and 20 may not apply to you.
- NO THIRD-PARTY BENEFICIARIES
You agree that, except as otherwise expressly provided in this TOS, there shall be no third-party beneficiaries to this agreement.
XVI. NOTICE
Travel Like Wind may provide you with notices, including those regarding changes to the TOS, including by but not limited to email, regular mail, SMS, MMS, text message, postings on the Travel Like Wind Services, or other reasonable means now known or hereafter developed. Such notices may not be received if you violate this TOS by accessing the Travel Like Wind Services in an unauthorized manner. Your agreement to this TOS constitutes your agreement that you are deemed to have received any and all notices that would have been delivered had you accessed the Travel Like Wind Services in an authorized manner.
XVII. GENERAL INFORMATION
Entire Agreement. The TOS constitutes the entire agreement between you and Travel Like Wind and governs your use of the Travel Like Wind Services, superseding any prior version of this TOS between you and Travel Like Wind with respect to the Travel Like Wind Services. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other Travel Like Wind Services, affiliate services, third-party content or third-party software.
XVIII. CHOICE OF LAW AND FORUM
You and Travel Like Wind each agree that the TOS and the relationship between the parties shall be governed by the laws of the jurisdiction of the Republic of Seychelles, without regard to its conflict of law provisions and that any and all claims, causes of action or disputes (regardless of theory) arising out of or relating to the TOS, or the relationship between you and Travel Like Wind, shall be brought exclusively in the courts located in the Republic of Seychelles. You and Travel Like Wind agree to submit to the personal jurisdiction of the courts mentioned above, and agree to waive any and all objections to the exercise of jurisdiction over the parties by such courts and to venue in such courts.
Waiver and Severability of Terms. The failure of Travel Like Wind to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. Suppose any provision of the TOS is found by a court of competent jurisdiction to be invalid. In that case, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect.
No Right of Survivorship and Non-Transferability. You agree that your Travel Like Wind account is non-transferable and any rights to your Travel Like Wind ID or contents within your account terminate upon your death. Upon receipt of a copy of a death certificate, your account may be terminated and all contents therein permanently deleted.
XIX. STATUTE OF LIMITATIONS
You agree that regardless of any statute or law to the contrary, any claim or cause of action by you arising out of or related to use of the Travel Like Wind Services or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred.
Titles. The section titles in the TOS are for convenience only and have no legal or contractual effect.
